Marc GOUDEN is one of the partners of the firm. His law studies were followed, several years later, by a special degree in tax law (ESSF). As of the end of his studies in 1998 he is a member of the Brussels Bar. Since 2004, he is also a member of the Bar in his native country, Luxembourg. Within Philippe & Partners, Marc is part of the business law department where he is in charge of contract law, insurance and liability issues and the energy sector.
His practice in contract law focuses on drafting and negotiating national and international contracts (sale of goods, service agreements, commercial distribution, lease, real estate ... with special expertise in liability, warranties and arbitration related clauses), as well as management of litigation related to contracts, not only before Belgian, Luxembourg or European Courts, but also before national or international arbitration chambers.
In the insurance sector he has developed special expertise in the following areas: freedom of establishment and free movement of services (mandatory regulations applicable to contracts, regulatory aspects,...), money laundering legislation, intermediaries, (captive) reinsurance, as well as winding up or transfer of business of insurance companies.
A privileged relationship with energy providers gave him the opportunity to gain good knowledge of this sector and especially its particular or technical aspects (transport and distribution, green certificates, nuclear materials,...), but also its liberalisation.
